Agency Terms

These Agency Terms & Conditions explain how partner agencies use SmileAtTheSun and the responsibilities that apply to services published on the platform.

About the Platform

SmileAtTheSun is a tourism and referral platform that helps connect customers with licensed partner agencies. All tours, transfers and similar services listed on the platform are provided by independent partner agencies.

SmileAtTheSun does not directly sell tours, transfers or travel services and does not operate as a tour operator, travel agency or direct service provider. The platform only facilitates the connection between customers and partner agencies.

All responsibilities related to pricing, reservations, operations, customer service, insurance coverage, legal permits, transportation, guides and service execution belong solely to the relevant partner agency.

Agency Responsibility and Legal Compliance

By using the platform, partner agencies confirm that they are legally authorized to provide the services they publish and that they hold any licenses, permits or authorizations required in their country or region.

Agencies are solely responsible for complying with tourism laws, tax regulations, insurance obligations, consumer protection laws and all other local legal requirements related to their services and operations.

Partner agencies are solely responsible for the proper delivery of all services they publish on the platform, including but not limited to tours, shuttle transfers, VIP transfers, real estate services, beauty and wellness services, and any other services listed on the platform.

If a service is delayed, cancelled, not provided, or performed improperly, all related customer obligations, complaints, refunds, compensation claims and legal responsibilities belong exclusively to the relevant partner agency.

SmileAtTheSun's role is limited to transmitting customer leads and facilitating contact between customers and partner agencies. SmileAtTheSun is not responsible for operational failures, service interruptions or customer damages arising from the agency's performance.

SmileAtTheSun takes customer feedback and complaints seriously. If customer grievances are not resolved appropriately and within a reasonable time, the platform reserves the right to issue warnings, withhold payments, temporarily suspend the partnership, remove listings, or permanently terminate the agency account.

SmileAtTheSun and partner agencies are fully independent parties. Nothing within these terms creates a partnership, franchise, employment relationship or official representation between the platform and any agency.

Lead System and Platform Structure

The platform does not guarantee any minimum number of customers, leads or revenue.

Leads generated through the platform may be reviewed manually or automatically for fraud prevention, duplicate activity, spam traffic or suspicious behavior.

Partner agencies are responsible for reviewing and responding to incoming leads fairly and honestly. Agencies must provide a reasonable explanation when rejecting leads.

If an agency intentionally marks valid leads as rejected, cancelled or invalid in order to avoid platform payments or field marketer earnings, the platform reserves the right to suspend all listings, temporarily or permanently suspend the account and block the creation of new accounts.

SmileAtTheSun may use mystery customers, quality checks, customer feedback or direct customer verification methods in order to evaluate service quality, investigate complaints or detect falsely rejected leads.

The platform may contact customers directly to verify lead quality, service quality or operational accuracy when necessary.

Agencies are responsible for ensuring that the descriptions, images, prices and service information they publish on the platform are accurate, up to date and not misleading.

Pricing and Customer Treatment

Prices displayed on the platform are considered base prices approved by the relevant agency. Agencies may not charge customers higher prices than the prices displayed on the platform without a valid and clearly communicated reason.

Customer complaints are taken seriously by the platform. Disrespectful behavior, misleading communication, aggressive customer treatment or repeated complaints may result in listings being removed or agency accounts being temporarily or permanently suspended.

Field Marketer Relationship

Field marketer users are independent platform users and are not employees, representatives or official business partners of partner agencies.

Agencies may not direct, encourage or pressure field marketer users to engage in illegal sales activities, aggressive street sales or misleading customer behavior.

Agencies may not attempt to bypass the platform's commercial relationships by directly recruiting, pressuring or redirecting field marketer users outside the platform.

If the platform determines that an agency is attempting to damage field marketer relationships or bypass the system, the agency account may be temporarily or permanently suspended.

Payments and Financial Responsibility

Partner agencies are responsible for all payment obligations related to leads generated and approved through the platform.

Field marketer payments are processed only after the platform has successfully received payment from the relevant partner agency.

If an agency fails to fulfil its payment obligations, the relevant agency is solely responsible for delayed or unpaid amounts. Where necessary, the platform may share the relevant agency information with affected field marketer users or direct users to the agency for payment resolution purposes.

SmileAtTheSun does not operate as a bank, escrow service or financial institution.

Brand and Platform Usage

Agencies may not use the SmileAtTheSun name, logo or platform materials in a misleading, modified or unauthorized manner.

Agencies may not falsely present themselves as the official owner, headquarters, legal representative or exclusive operator of the platform.

Technical Corrections and Platform Rights

SmileAtTheSun reserves the right to investigate and correct technical issues, system vulnerabilities, incorrect calculations, duplicate earnings, payment errors or platform malfunctions.

Earnings, payments or account activity incorrectly generated due to technical problems or software errors may be corrected, reversed or considered invalid by the platform.

The platform may occasionally experience temporary interruptions due to maintenance, updates or technical problems. SmileAtTheSun does not guarantee uninterrupted platform access.

Right to Modify These Terms

SmileAtTheSun reserves the right to update, modify or revise these terms in line with legal, operational, technical or commercial requirements.

Updated terms may be considered effective from the moment they are published on the platform.

Account Suspension and Removal

SmileAtTheSun reserves the right to temporarily or permanently suspend agency accounts, listings or platform access in cases involving suspicious activity, suspected fraud, manipulation attempts, abuse of the platform, repeated customer complaints, misleading behavior or violations of these terms.

Privacy

Information provided by agencies may be processed for account management, security checks, operational processes, payment tracking and platform functionality.

Acceptance

By creating an agency account on the platform, all users confirm that they have read, understood and accepted these Terms & Conditions.
