Field Marketer Terms

These Terms & Conditions explain how the SmileAtTheSun platform works and the rules that apply to field marketer users.

About the Platform

SmileAtTheSun is a tourism and referral platform that helps connect customers with licensed partner agencies. All tours, transfers and similar services listed on the platform are provided by independent partner agencies. SmileAtTheSun only helps establish contact between the customer and the relevant agency and does not act as a direct tour operator, travel agency or service provider.

SmileAtTheSun does not directly sell tours, transfers or travel services. All responsibility for service sales, pricing, booking confirmation, operational processes, insurance coverage, legal permits and the actual provision of the service belongs to the relevant partner agency.

Account Use and Responsibility

Everyone using the platform accepts that the information they provide is accurate and up to date. Users are responsible for the security of their own account information and may not share their accounts with third parties.

The platform reserves the right to investigate any misuse of the platform, attempted system manipulation or submission of misleading information.

Field Marketer System

Field marketer users are not employees of SmileAtTheSun. The platform does not provide any work obligation, minimum working time, salary, insurance, fixed payment or job guarantee. No employer-employee relationship is established between the platform and field marketer users.

These terms do not create any partnership, representation, franchise or official business partnership relationship.

The field marketer system is an independent affiliate model in which users may voluntarily carry out promotional and referral activities within the legal limits of their own countries. Users may stop using the platform at any time.

The platform does not provide any minimum income or earning guarantee.

Promotion and Conduct Rules

Field marketer users may not act as official representatives, employees, sales agents, tour operators or agencies on behalf of the platform. Users may not give guarantees, definite promises or binding sales commitments on behalf of SmileAtTheSun.

Field marketer users are not authorized to sell services directly or collect payments from customers. All sales and payment processes are carried out only by authorized partner agencies.

SmileAtTheSun does not accept direct online payments. All payments must be made only to the relevant partner agency.

Field marketer users are prohibited from collecting fees from customers, receiving payments or carrying out financial transactions on behalf of the platform. Any legal, financial or criminal responsibility arising from such actions belongs entirely to the relevant user.

Field marketer users may only recommend the platform or related services and make referrals. Service sales and operational processes are carried out only by authorized partner agencies.

Platform users may not engage in spam, misleading advertising, disturbing promotions, coercive behavior, aggressive sales attempts, fake referrals or marketing activities that violate local laws. Promotional activities that disturb people, create pressure or mislead others are prohibited.

Users are responsible for complying with the tourism, advertising, referral and commercial activity regulations of their own countries.

The platform brand, logo or materials may not be used in a misleading, modified or unauthorized manner.

Lead System and Platform Revenue

Revenue generated through the platform is evaluated only based on valid leads approved by the relevant partner agency.

Fake leads, duplicate transactions, system manipulation, self-booking attempts, artificial traffic, spam activities or suspicious behavior may be considered invalid by the platform.

In suspicious cases, the platform reserves the right to review transactions through manual or automated systems, cancel leads, hold payments, limit payments or stop payments completely.

Category-Based Earning Limitation

Field marketer earnings may be limited to specific service categories determined by the platform.

At the current stage, field marketer earnings are available only for valid leads generated from the Tour and Shuttle Transfer categories.

Leads from other categories may also be collected and forwarded to partner agencies and may become eligible for field marketer earnings if and when the platform enables such categories in the future.

The platform reserves the right to enable, disable or modify earning eligibility for specific service categories at any time.

Referral Tracking and Technical Limitations

Referral tracking may be performed through cookies, referral links, QR codes, URL parameters or similar technical methods.

Referral attribution may not be possible in cases such as blocked cookies, removed referral URLs, privacy or ad-blocking tools, device changes, browser changes, private browsing settings or similar technical limitations.

No right, earning or payment guarantee is provided for referrals that cannot be technically verified by the platform.

Agency Payments and Responsibility

Field marketer payments are processed only after the relevant partner agency has successfully made the required payment to the platform.

If the platform cannot collect payment from the relevant agency, the relevant partner agency is responsible for delayed or unpaid amounts. Where necessary, the platform may share the relevant agency information with the field marketer user or direct the user to the relevant agency in order to help resolve the payment process.

Partner agencies are responsible for their payment obligations regarding leads generated and approved through the platform.

Technical Problems and System Corrections

SmileAtTheSun reserves the right to review and correct technical errors, system vulnerabilities, incorrect calculations, duplicate revenue records or incorrect payment records.

Revenue, payments or account movements incorrectly created due to technical failures, software errors or system problems may be considered invalid.

The platform may occasionally experience temporary access issues due to maintenance, updates or technical reasons. SmileAtTheSun does not guarantee uninterrupted access.

Right to Modify These Terms

SmileAtTheSun reserves the right to update, modify or revise these terms in line with legal, technical, operational or commercial requirements.

Updated terms may be considered effective from the moment they are published on the platform.

Account Suspension and Termination

The platform reserves the right to temporarily or permanently suspend user accounts in cases of suspicious activity, suspected fraud, misuse, system manipulation, behavior damaging the platform's reputation or violation of these terms.

Tax and Legal Obligations

Platform users are responsible for their own tax, income reporting, commercial activity and other legal obligations in their respective countries.

If income is generated, the user is responsible for making any necessary declarations to the relevant tax authorities.

Privacy

Information provided by users may be processed for account management, security checks, lead processes, payment procedures and platform operations.

Acceptance

All users who create an account on the platform are deemed to have read, understood and accepted these terms.
